Unclaimed Tax Refunds: The Three-Year Rule

How long you have to claim an IRS refund, how to file old returns, and what to do about a refund check you never cashed.

The rule in one sentence

If you did not file a federal tax return and you were owed a refund, you generally have three years from the original filing deadline to file and claim it. After that, the refund is typically lost. This is why checking past years can matter, especially for people whose income was low or who had withholding taken from pay.

How the deadline works

The filing deadline is usually in mid-April. Three years after that date is your cutoff. Examples (assuming the standard April 15 deadline):

How to file a past return

  1. Get your income records. If you cannot find W-2s or 1099s, the IRS "Get Transcript" tool provides wage and income information.
  2. Use the forms and instructions for that specific tax year from IRS.gov.
  3. File by mail (past-year returns often cannot be e-filed) and keep proof of mailing.
  4. Use the IRS refund-status tool afterward.

Uncashed or lost refund checks

If a refund check was lost, stolen or expired, contact the IRS to request a replacement. The IRS refund-status tool can show whether a refund was issued. Update your address with the IRS so future mail reaches you.

Does this apply to state refunds?

States have their own deadlines, which may differ. Check your state revenue department.
